Terms and Conditions

  1. In order to use Eistudy’s services, you must read and comply with the Eistudy User Agreement (“Agreement”) and the Privacy Statement. It is important that you read and fully understand the terms and conditions, in particular those that exclude or limit liability, as well as the separate agreements for the opening or use of a particular service. Limitations and exclusions of liability may be brought to your attention in bold.
    You are not authorized to use the services provided by Eistudy unless you have read and accepted all of the terms of this Agreement. By using Eistudy’s services, you are deemed to have read and agreed to be bound by the above agreement.
  2. If you are under 18 years of age, please read this agreement with a legal guardian and pay particular attention to the terms of use for minors.
    I. Scope of the Agreement
    1.1 This Agreement is an agreement between you and Eistudy regarding the use of the Eistudy related services by the User. “Eistudy” means EI Holdings (Singapore) Pte. Ltd. and its possible operating affiliates in relation to the Services. “User” means the user of the Eistudy Related Services, more commonly referred to in this Agreement as “You”.
    1.2 The Services under this Agreement are the products and services provided by Eistudy to the User, including but not limited to study abroad applications, peer-to-peer services, visa processing, etc. (hereinafter referred to as the “Services”).
    1.3 This Agreement also includes the Privacy Policy, and there may be separate agreements and business rules for your use of a particular Eistudy service (collectively, the “Separate Agreements”). Upon posting, these will become an integral part of this Agreement and you will be bound by them. Your acceptance of any of the foregoing business rules and separate agreements shall be deemed to be your acceptance of this Agreement in its entirety.
    II. Account and Password Security
    2.1 You may be required to register for an account in order to use the Eistudy Services. For specific rules regarding your use of your account, please comply with the Privacy Statement and the Separate Agreement.
    2.2 Eistudy specifically reminds you that you should keep your account and password secure. When you have finished using them, you should log out safely. You are responsible for any theft of your account or password that may occur as a result of poor storage.
    III. Protection of Users’ Personal Information
    3.1 The protection of your personal information is a fundamental principle of Eistudy.
    3.2 In the process of registering an account or using the service, you may need to fill in some necessary information. If there are special provisions in the national laws and regulations, you need to fill in the real identity information. If the information you fill in is incomplete, you will not be able to use the Service or will be restricted in the process of using it.
    3.3 In general, you may view and amend the information you have submitted at any time, but for security and identification reasons (e.g. for study abroad application services), you may not be able to amend the initial registration information and other verification information provided at the time of registration.
    3.4 Eistudy will use various security technologies and procedures to establish a sound management system to protect your personal information from unauthorised access, use or disclosure.
    3.5 Eistudy will not disclose your personal information to any company, organisation or individual outside of Eistudy without your consent, except where otherwise required by law or regulation.
    3.6 Eistudy takes the protection of personal information of minors very seriously. If you are a minor under the age of 18, you should obtain the prior written consent of your parent or legal guardian (“Guardian”) before using Eistudy’s services.
    How we share, transfer and publicly disclose your personal information
    4.1 Sharing
    We will not share your personal information with any company, organisation or individual other than [name of subject of information collection], except in the following circumstances.
    (1) Sharing with explicit consent: We will share your personal information with other parties after obtaining your explicit consent.
    (2) We may share your personal information with external parties as required by law or regulation, or as mandated by government authorities.
    (3) Sharing with our affiliates: Your personal information may be shared with affiliates of [name of subject of information collection]. We will only share personal information that is necessary and is subject to the purposes stated in this Privacy Policy. If an affiliate wishes to change the purposes for which personal information is processed, it will again seek your authorized consent.
    (4) Sharing with Authorised Partners: Some of our services will be provided by authorised partners for the sole purpose of achieving the stated purposes in this policy. We may share some of your personal information with our partners in order to provide better customer service and user experience. We will only share your personal information for purposes that are legal, legitimate, necessary, specific and explicit, and only as much personal information as is necessary to provide the service. Our partners do not have the right to use the personal information shared for any other purpose.
    Currently, our authorised partners include the following broad categories.
    1) Suppliers, service providers and other partners. We send information to suppliers, service providers and other partners who support our business globally by providing technical infrastructure services, analyzing how our services are used, measuring the effectiveness of advertising and services, providing customer service, facilitating payments or conducting academic research and surveys.
    (2) We enter into strict confidentiality agreements with companies, organisations and individuals with whom we share personal information, requiring them to handle personal information in accordance with our instructions, this Privacy Policy and any other relevant confidentiality and security measures.
    4.2 Transfers
    We will not transfer your personal information to any company, organisation or individual except.
    (1) Transfers with express consent: we will transfer your personal information to other parties after obtaining your express consent.
    (2) In the event of a merger, acquisition or liquidation involving the transfer of personal information, we will require the new company or organisation holding your personal information to continue to be bound by this privacy policy before we require that company or organisation to seek authorised consent from you again.
    4.3 Public Disclosure
    We will only disclose your personal information publicly if.
    (1) With your express consent.
    (2) Disclosure on the basis of law: we may disclose your personal information publicly if compelled to do so by law, legal process, litigation or governmental authority.
    V. How our partners use your personal information
    5.1 Information Collection and Storage
    (1) You hereby agree that we may share your personal information with our partners with whom we have a relationship.
    (2) The partner will ask for and verify your basic information (name, weibo, school, qualifications, intended country of application, how to apply for study abroad, etc.) by phone, SMS, email, etc.
    (3) The partner will store your personal information obtained through us and through communication with you by phone, SMS or email in their CRM (Customer Relationship Management System).
    5.2 Use of information
    You hereby consent to the use of your personal information by our partners for the following purposes.
    (1) The partner analyses the information obtained and provides you with study abroad advisory services based on the results of the analysis.
    (2) The partner recommends suitable third party service providers (including but not limited to language training providers and study abroad consultancy providers) to you based on your needs.
    5.3 Information sharing and transfer
    (1) You hereby agree that the partner may provide your basic personal information (limited to your name, mobile phone number and interest in studying abroad) to third party organisations such as language training providers and study abroad consultancies and that the third party organisations will follow up with you by calling you to discuss relevant matters.
    (2) The third party organization guarantees that it will not share, transfer or sell your personal information obtained from its partners to anyone; it guarantees that it will not process or analyze your personal information in any form, except with your consent and authorization.
    5.4 Service cancellation and information deletion
    (1) When providing the above services, the partner will provide you with ways and procedures to cancel the service, and you can cancel the service at any time in accordance with the corresponding procedures.
    (2) You may at any time request the partner to delete your personal information stored in the CRM, except for information that cannot identify you personally after analysis and processing by the partner.
    VI. How to use the Service
    6.1 Unless otherwise agreed between you and Eistudy, you agree that the Service is for your personal, non-commercial use only.
    6.2 You shall use the Service in the manner provided or approved by Eistudy. Your rights under the terms of this Agreement are not transferable.
    6.3 You may not use plug-ins, plug-ins or third party tools that are not authorised by Eistudy to interfere with, disrupt, modify or otherwise affect the Services under this Agreement.
    vii. provision of the services as is
    7.1 You understand and agree that Eistudy’s Services are provided on an “as is” basis in accordance with current technology and conditions and that Eistudy will endeavour to provide the Services to you in a manner that ensures the continuity and security of the Services; however, Eistudy cannot at all times anticipate and protect against legal, technical and other risks, including but not limited to force majeure, viruses, Trojan horses, hacker attacks, system instability, defects in third party services, governmental actions, etc. Any interruption of services, loss of data and other losses and risks that may be caused by third party service defects, government action, etc.
    VIII. Self-provided Equipment
    8.1 You should understand that you are required to provide your own terminal equipment (e.g. computer, modem, etc.) in connection with the Services and bear the costs thereof (e.g. telephone charges, internet access charges, etc.).
    8.2 You understand and agree that your use of the Services will consume resources such as your terminal equipment and bandwidth.
    IX. Advertising
    9.1 You agree that Eistudy may send you advertising, promotional or publicity information (including commercial and non-commercial information) in the course of providing the Services, either on its own or by third party advertisers, in any manner and to any extent that may be changed without specific notice to you.
    9.2 Eistudy may provide you with the ability to opt out of advertising messages, but you may not at any time block or filter advertising messages in a manner not expressly agreed to in this Agreement or permitted by Eistudy in writing.
    9.3 Eistudy shall perform its obligations to the Advertisers in accordance with the law and you shall judge the authenticity of the Advertised Information yourself and be responsible for your own actions in doing so, and Eistudy shall not be liable for any loss or damage suffered by you as a result of transactions conducted in reliance on the Advertised Information or the content provided by the aforementioned Advertisers, except as expressly provided by law.
    9.4 You agree that you shall exercise due care in determining the truthfulness and reliability of advertising information appearing on the Eistudy Services and that you shall be responsible for transactions conducted in reliance on such advertising information, except as expressly provided by law.
    X. Fee-based services
    10.1 Eistudy does not charge you any fees for the study application process, other than third party fees.
    10.2 Eistudy will inform the user in a timely manner when third party fees such as application fees, visa fees, school deposits and postage fees are required to be paid, such as the content and amount that the user is required to pay on their own, its included. Eistudy is not responsible for any disputes or controversies arising from underpayment, non-payment or late payment of such fees by the User.
    10.3 Some of Eistudy’s services are provided on a fee basis and if you use the fee-based services, please comply with the relevant agreement.
    10.4 Eistudy may modify and change the rates and methods of charging for the fee-based services as necessary, and Eistudy may also start charging for some of the free services. Before such modifications, changes or charges are introduced, Eistudy will notify or announce them on the respective service pages. If you do not agree with the aforementioned modifications, changes or paid content, you should stop using the service.
    XI. Products or services provided by third parties
    11.1 When you use products or services provided by third parties on the Eistudy Platform, you shall, in addition to complying with this Agreement, also comply with the user agreement of the third party, and Eistudy and the third party shall each be liable for any disputes that may arise to the extent provided by law and agreed upon.
    XII. Software on the Service
    12.1 You may need to download software in the course of using the Service and Eistudy grants you a personal, non-transferable and non-exclusive licence for such software. You may use such software only for the purpose of accessing or using the Service.
    12.2 Eistudy may update the Software in order to improve the user experience, the security of the Service and the consistency of product functionality. You should update the relevant software to the latest version, otherwise Eistudy does not guarantee that it will work.
    xiii. intellectual property rights notice
    13.1 The intellectual property rights in the content provided by Eistudy on the Service (including but not limited to web pages, text, images, audio, video, graphics, etc.) are owned by Eistudy and the intellectual property rights in the content generated by the User in the use of the Service are owned by the User or the relevant rights holder.
    13.2 Unless otherwise specifically stated, the copyrights, patents and other intellectual property rights in the software on which Eistudy relies to provide the Service are owned by Eistudy.
    13.3 The commercial logos “Eistudy”, “Abroad.me”, “65house”,”Youclass”,”65pr” etc. used by Eistudy in connection with the Service “Eistudy”, “Abroad.me”, “65house”,”Youclass”,”65pr” and other commercial logos used in the Service are subject to copyright or trademark rights owned by Eistudy.
    13.4 The intellectual property rights of the above and any other content contained in the Service are protected by law and no one is allowed to use them in any form or create related derivative works without the written permission of Eistudy, the User or the relevant right holder.
    XIV. User Violations
    14.1 You must comply with the laws and regulations when using the Service and must not use the Service to engage in illegal or unlawful conduct, including but not limited to
    (1) publishing, transmitting, disseminating or storing content that endangers national security and unity, undermines social stability, violates public order and morality, insults, defamation, obscenity, violence or any content that violates national laws and regulations.
    (2) Publishing, transmitting, disseminating, or storing content that infringes the intellectual property rights, commercial secrets, and other legal rights of others.
    (3) Maliciously falsifying facts or concealing the truth in order to mislead or deceive others.
    (4) Publishing, transmitting and disseminating advertising information and spam
    (5) Other acts prohibited by laws and regulations.
    14.2 If you violate the provisions of this Agreement, the relevant state authorities or institutions may institute legal proceedings, impose fines or take other sanctions against you and request Eistudy’s assistance. You shall be liable to pay compensation for any damage caused in accordance with the law and Eistudy shall not be liable for any such damage.
    14.3 If Eistudy discovers or receives a report that you have posted information that violates this Agreement, Eistudy reserves the right to remove, block or disconnect the link at its sole discretion and by technical means. At the same time, Eistudy reserves the right to take measures, including but not limited to suspension or termination of services, restriction, freezing and legal responsibility, depending on the nature of the user’s actions.
    14.4 You shall be solely responsible for any damage caused to any third party as a result of your breach of this Agreement; you shall also compensate Eistudy for any loss suffered as a result.
    XV. Compliance with local laws and regulations
    15.1 You should comply with relevant local laws and regulations and respect local morals and customs in the course of using the Service. If you act in breach of local laws and regulations or morals and customs, you shall be solely responsible for doing so.
    15.2 You should avoid involving Eistudy in political and public events as a result of using the Service, otherwise Eistudy reserves the right to suspend or terminate the Service to you.
    XVI. Content sent and transmitted by users and handling of third party complaints
    16.1 You are solely responsible for any content (including but not limited to web pages, text, images, audio, video, graphics, etc.) that you send or transmit through the Service.
    16.2 The content you send or transmit shall be of legal origin and the content shall be owned by you or you shall have obtained the authorisation of the right holder.
    16.3 You agree that Eistudy may use the Content you send or transmit for the purpose of fulfilling this Agreement or providing the Service.
    16.4 If Eistudy is notified by a rights holder that content sent or transmitted by you infringes its rights in relation to such content, you agree that Eistudy has the right to remove, block or disconnect such content at Eistudy’s sole discretion.
    Force Majeure and Other Exclusions
    17.1 You understand and agree that in the course of using the Services, you may encounter force majeure and other risk factors that may cause disruptions to the Services. Force majeure means an objective event which cannot be foreseen, overcome and avoided and which materially affects one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics and storms, and social events such as war, unrest, governmental action, etc. In the event of such an event, Eistudy will endeavour to work with the relevant parties in the first instance to repair the situation in a timely manner, but Eistudy is exempt from liability for any damage caused to you as a result of such events to the extent permitted by law.
    17.2 To the extent permitted by law, Eistudy shall not be liable for any interruptions or disruptions to the service caused by
    (1) Damage by computer viruses, Trojan horses or other malicious programs or hacking attacks.
    (2) Failure of the user or Eistudy’s computer software, systems, hardware and communication lines.
    (3) Improper operation by the User.
    (4) Use of the Service by the User through means other than those authorized by Eistudy.
    (5) other circumstances beyond Eistudy’s control or reasonably foreseeable.
    17.3 You understand and agree that in the course of using the Service, you may encounter risks arising from network information or other user actions and that Eistudy is not responsible for the truthfulness, suitability or legality of any information or for any damage caused to you as a result of infringement. These risks include, but are not limited to.
    (1) Information containing threatening, defamatory, offensive or unlawful content from another person, either anonymously or by impersonation.
    (2) Any psychological or physical harm and financial loss suffered or likely to be suffered as a result of misleading, deceptive or otherwise caused by others as a result of using the services under this agreement.
    (3) Any other risks arising from network information or user conduct.
    17.4 You understand and agree that the Service is not designed for certain specific purposes, including but not limited to nuclear facilities, military use, medical facilities, transportation communications and other critical areas. Eistudy shall not be liable for injury or death to persons, damage to property or damage to the environment if such operations fail as a result of the Software or the Services.
    17.5 Eistudy is granted the right to deal with offending content in accordance with this agreement, which does not constitute an obligation or commitment on the part of Eistudy, and Eistudy cannot guarantee that violations will be detected or dealt with accordingly in a timely manner.
    17.6 You should not, under any circumstances, rely on loans, requests for passwords or other online information involving property. Where property operations are involved, please always verify the identity of the other party first and always look out for Eistudy’s tips on preventing fraudulent crime.
    XVIII. Entry into force and changes to the Agreement
    18.1 By using Eistudy’s services, you are deemed to have read and accepted this Agreement.
    18.2 Eistudy reserves the right to amend the terms of this Agreement if necessary. You can review the latest version of these Terms of Use on the relevant Services page.
    18.3 If you continue to use the Software or Services provided by Eistudy after the terms of this Agreement have been changed, you will be deemed to have accepted the amended Agreement. If you do not accept the modified agreement, you should stop using the software or services provided by Eistudy.
    XIX. Changes, interruptions and termination of services
    19.1 Eistudy may make changes to the Services and may also discontinue, suspend or terminate the Services.
    19.2 Eistudy reserves the right to interrupt or terminate the Services provided to you without notice if any of the following occurs.
    (1) You are required by law to submit truthful information and the personal data you provide is untrue or inconsistent with the information provided at the time of registration and you fail to provide reasonable proof.
    (2) You violate the relevant laws and regulations or the agreement of this Agreement.
    (3) In accordance with the provisions of the law or the requirements of the competent authorities.
    (4) For security reasons or other necessary circumstances.
    19.3 Eistudy shall be entitled to charge the fees set out in Section 8 of this Agreement. Eistudy reserves the right to interrupt, suspend or terminate the provision of the Services if you do not pay in full and on time.
    19.4 You are responsible for backing up your data stored on the Service. If Your Service is terminated, Eistudy may permanently delete Your data from the server. Eistudy is not obliged to return data to you after termination of the Service.
    xx. jurisdiction and application of law
    20.1 This Agreement is entered into in Zhabei District, Shanghai, People’s Republic of China.
    20.2 The laws of the mainland of the People’s Republic of China (excluding conflict of laws) shall apply to the formation, validity, performance, interpretation and dispute resolution of this Agreement.
    20.3 In the event of any dispute or controversy between you and Eistudy, the dispute or controversy shall first be settled amicably; if negotiation fails, you agree to submit the dispute or controversy to the jurisdiction of the competent people’s court in the place where this Agreement is entered into.
    20.4 The headings of all provisions of this Agreement are for convenience only and have no actual meaning of their own and shall not be relied upon in interpreting the meaning of this Agreement.
    20.5 The remaining provisions of this Agreement shall remain valid and binding on both parties, irrespective of whether they are partially invalid or unenforceable for whatever reason.
    XXI. Terms of Use for Minors
    21.1 If the User is under 18 years of age, the User is a minor and shall read this Agreement and use the Service under the supervision and guidance of a guardian.
    21.2 Users who are minors are not yet involved in the world and are easily confused by false images on the internet, and are curious and lack the ability to deal with situations in an improvised manner, and are easily exploited by people with ulterior motives and lack the ability to protect themselves. Therefore, when using the service, minor users should pay attention to the following matters in order to raise their awareness of safety and strengthen their self-protection.
    (1) Recognise the difference between the online world and the real world and avoid becoming addicted to the Internet, which may affect their daily school life.
    (2) When filling in personal data, strengthen your sense of personal protection to avoid harassment of your personal life by undesirable elements.
    (3) Learn to use the Internet properly under the guidance of a guardian or teacher.
    (4) Avoid casual meetings with unfamiliar Internet friends or participation in association activities to avoid unruly elements taking advantage of them and endangering their safety.
    21.3 Guardians and schools should provide guidance to minors in the use of the service. In particular, parents should be concerned about the development of their children, pay attention to communication with their children and guide them on the safety issues they should pay attention to when using the Internet, so as to prevent problems before they occur.
  3. Income
    22.1 You acknowledge and agree that the income you receive from the App and related channels provided by Eistudy is your own general remuneration for services rendered and you agree and authorise the company developing the App or its affiliates to withhold and pay personal income tax on your behalf.
    22.2 You agree to provide and fill in your ID card number and bank card number by yourself.
